DaveCorp Biohazard HVAC

17. Arbitraje y renuncia a demandas colectivas

Lee esta sección. Afecta tus derechos.

Terms of Use

Version 2026-10-28 · Effective October 28, 2026

The short version

DaveCorp Biohazard HVAC is a technology platform. We connect homeowners with independent, licensed HVAC companies and give those companies software to run their business. We do not perform HVAC work. The company you choose does the work and is responsible for it.

Disputes go to individual arbitration, not court, except small-claims cases. You give up class actions and jury trials. You can opt out of arbitration within 30 days of creating your account (section 17).

DaveCorp Protect is a benefits membership. It is not insurance, not a warranty and not a service contract, and it does not pay for repairs.

1. Who we are and these Terms

DaveCorporate Biohazard, Inc. ("DaveCorp", "we", "us"), a Florida corporation at 4107 Ramiro St, Sebring, FL 33872, operates DaveCorp Biohazard HVAC: the website davecorpbiohazard.com, the app at app.davecorpbiohazard.com, the homeowner portal and related services (the "Service").

These Terms of Use (the "Terms") are a contract between you and DaveCorp. By checking the box to accept them when you create an account, or by using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the platform is (and is not)

  • DaveCorp is a technology platform. We are not an HVAC contractor, we do not perform, supervise or guarantee HVAC work, and we do not employ the technicians who do it.
  • HVAC services are provided by independent companies that are responsible for holding the licenses Florida law requires (Chapter 489, Florida Statutes), their insurance, their prices, their work and their warranties.
  • When you request service, the agreement for the work is between you and the company. Quotes, invoices, schedules, warranties on work and any dispute about the work are between you and that company.
  • We do not check every company's license, insurance or work and we do not endorse any company. Before work starts, you may verify a contractor's license with the Florida Department of Business and Professional Regulation (myfloridalicense.com).

3. Accounts and eligibility

  • You must be at least 18 years old and able to enter into a contract. The Service is not for children; we do not knowingly collect information from children under 13.
  • Give accurate information and keep it current. Keep your password secret; you are responsible for activity under your account. Tell us right away at corp@davecorpbiohazard.com if you think your account was used without permission.
  • You may sign in with Google. Google's own terms apply to your Google account.

4. Homeowners

  • You can register your home equipment, choose a primary company, request service or send emergency requests. An emergency request may go to several companies; the first one to accept gets the job.
  • For emergencies involving smoke, fire, gas smell or risk to people, call 911 first. The Service is not an emergency-response service and we cannot promise that any company will accept or arrive within a certain time.
  • The companies you choose can see your request, contact details, address and the equipment you registered. Your primary company can also see and verify your units.

5. Platform fees

  • Some portal requests carry a DaveCorp platform fee: currently $12.00 for an emergency dispatch and $3.99 for any other booking. The amount is shown before you send the request and you must agree to it.
  • The fee is charged only if a company accepts your request. It appears as a separate line on the company's quote or invoice, is not taxed or discounted, and the company collects it for DaveCorp.
  • If the company that accepted does not come and the visit does not happen, contact us and we will remove or refund the fee.
  • Active DaveCorp Protect members do not pay these fees while the membership is active.
  • We may change these fees for future requests; the amount that applies is always the one shown before you send.

6. DaveCorp Protect

  • DaveCorp Protect is a membership sold and billed by DaveCorp (not by the companies). Plans, prices and benefits are shown on the Plan screen before you request one. Benefits can include no platform fees, emergency priority, reminders and included maintenance visits.
  • Included maintenance visits are performed by your primary company, an independent contractor, under its agreement with DaveCorp. DaveCorp does not perform the visit.
  • Protect is not insurance, a home warranty or a service contract (Chapter 634, Florida Statutes). It does not pay for, discount or guarantee repairs, parts or equipment.
  • A membership starts when DaveCorp confirms your payment and runs for the period you chose. It renews for the same period unless you cancel the renewal in the app before the renewal date; benefits continue until the end of the paid period. Unused visits do not carry over.
  • Refunds are handled case by case and as required by law. Write to us if something went wrong.

7. HVAC companies and technicians

If you use the Service for a business (owner or technician), these Terms apply together with any agreement your company signs with DaveCorp, including the DaveCorp Contractor Agreement. If they conflict, the signed agreement controls.

  • Your company is responsible for its licenses, insurance, permits, taxes, prices, the work it performs, the warranties it gives and how it treats its customers and employees. Technicians act for their company, not for DaveCorp.
  • Your company owns its customer, job, quote and invoice records and is responsible for having the right to store them and to contact those customers, including under the TCPA and Florida's telemarketing laws when you send messages from your own phone apps.
  • The owner controls the company account, invites and deactivates members, and is responsible for what members do in it.
  • Companies that accept portal requests collect the platform fee with their invoice and owe it to DaveCorp. HVAC consulting ("Consultoría HVAC") questions are billed at the fee shown before you send, and only when the expert marks the question solved.
  • Prices in the catalog, quotes and invoices are set by your company. Supplier part numbers and prices you enter are your data.

8. Payments between you and a company

Quotes, invoices and payments for HVAC work are between the homeowner and the company. Today the Service only records payments and shows invoices; it does not process card payments. When online payments are added, they will be handled by third-party payment providers under their own terms, and we will update these Terms first.

9. Nameplate reading, warranty estimates and advice

  • The Service can read an equipment nameplate photo with artificial intelligence, estimate manufacture dates and warranty periods, and show suggestions. These results are informational and may be wrong. Check the data against the nameplate, and confirm warranty coverage with the manufacturer.
  • Maintenance reports, suggestions and HVAC consulting answers are not a substitute for an on-site inspection by a licensed technician. Do not open electrical panels or attempt repairs you are not qualified to do.

10. Messages, calls and texts

  • We send account emails (for example, verification and password reset). Companies may contact you about your requests, quotes, invoices and visits.
  • If we start sending text messages from DaveCorp, we will ask for your consent first and tell you what messages to expect. Message frequency varies; message and data rates may apply; reply STOP to stop and HELP for help. We do not share your text-message opt-in with third parties for their marketing.

11. Your content

You keep ownership of what you upload or write, such as photos, equipment data, notes and logos ("Your Content"). You give DaveCorp a non-exclusive, royalty-free, worldwide license to host, store, copy, process and display Your Content only to operate, protect and improve the Service and to share it with the companies or people you choose. You confirm you have the right to upload it. Copyright complaints follow our DMCA policy.

The Service itself (software, design, brand and text) belongs to DaveCorp and its licensors. You may use it only as these Terms allow.

12. Acceptable use

Do not: break the law; give false information or impersonate someone; post content that is illegal, harmful or that you have no right to share; harass anyone; send spam; access accounts or data that are not yours; scrape, copy or resell the Service; interfere with its security or operation; or use the Service to compete with it.

13. Suspension and termination

You may stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or close an account, or remove content, if we reasonably believe it breaks these Terms or the law, creates risk for others or for DaveCorp, or if required by law. When possible, we will tell you why. Sections that by their nature should survive (for example 11, 14 to 18) continue after termination.

14. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that any company will respond, or that any information shown (including AI readings and warranty estimates) is accurate. We make no warranty about HVAC work, which is the responsibility of the company that performs it.

15. Limitation of liability

To the maximum extent permitted by law: (a) DaveCorp will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; (b) DaveCorp is not liable for the acts, omissions, work, products or prices of any company, technician, supplier or homeowner; and (c) DaveCorp's total liability for all claims relating to the Service is limited to the greater of US$100 or the amount you paid to DaveCorp in the 12 months before the claim. Some laws do not allow these limits; in that case they apply only as far as the law allows.

16. Indemnification

To the extent permitted by law, you will defend, indemnify and hold harmless DaveCorp and its officers, employees and agents from claims, losses and costs (including reasonable attorney's fees) arising from your breach of these Terms, Your Content, your misuse of the Service or, for companies, the work you perform and your dealings with your customers and employees.

17. Arbitration and class-action waiver

Please read this section. It affects your rights. In short: disputes with DaveCorp are decided by a neutral arbitrator, one person at a time; small-claims court remains available; you can opt out within 30 days.

  • Talk to us first. Before starting a claim, send a written description of the dispute and what you want to corp@davecorpbiohazard.com. We will try to resolve it within 60 days.
  • Arbitration. If we cannot resolve it, any dispute between you and DaveCorp relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or, for business users, its Commercial Rules), under the Federal Arbitration Act. The arbitrator decides questions about the scope and enforceability of this section. Hearings may be held by video or phone, or in Highlands County, Florida, or the county where you live.
  • Fees. For consumer claims, DaveCorp pays all filing, administration and arbitrator fees above the amount you would pay to file a small-claims case, unless the arbitrator finds the claim frivolous.
  • Exceptions. Either party may bring an individual case in small-claims court, and either party may ask a court to stop infringement of intellectual property.
  • No class actions or jury trials. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding. You and DaveCorp waive the right to a jury trial.
  • 30-day opt-out. You can opt out of this section by emailing corp@davecorpbiohazard.com within 30 days after you first accept these Terms, with your name, your account email and a statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.
  • If the class waiver is not enforced for a claim, this arbitration section does not apply to that claim, which will go to the courts in section 18.

18. Governing law and venue

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Any claim not subject to arbitration will be brought only in the state or federal courts for Highlands County, Florida, and you and DaveCorp consent to their jurisdiction.

19. Changes, notices and other terms

  • We may update these Terms. We will change the version date above and, for important changes, tell you in the app or by email and ask you to accept the new version before continuing. Changes do not apply to disputes already notified to us.
  • If a part of these Terms is unenforceable, the rest remains in effect. Not enforcing a part is not a waiver. You may not transfer these Terms without our consent; we may transfer them with our business. These Terms, the Privacy Policy and any signed agreement with your company are the entire agreement about the Service.
  • These Terms are available in English and Spanish. If the versions differ, the English version controls, to the extent allowed by law.
