How to send a notice
If you believe content on the Service infringes your copyright, send our agent a written notice that includes:
- Your physical or electronic signature (or that of a person authorized to act for the copyright owner).
- Identification of the copyrighted work you claim is infringed.
- Identification of the material you claim is infringing and enough information for us to find it (for example, the page URL or the company name and screen).
- Your name, address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner's behalf.
When we receive a valid notice, we remove or disable access to the material promptly and inform the user who posted it. Knowingly false claims can create liability for damages under §512(f).
Counter-notice
If your content was removed and you believe it was a mistake or misidentification, you may send our agent a counter-notice that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district where DaveCorp may be found), and that you will accept service of process from the person who sent the original notice.
We forward valid counter-notices to the person who sent the original notice. Unless that person tells us they have filed a court action, we may restore the material 10 to 14 business days after receiving the counter-notice.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of users and companies who repeatedly infringe others' copyrights.
